Basic Building Information from the
Architectural Review Committee

 

Basic building requirements are found within the Covenants and Restrictions documents recorded for the development. If you own a lot, the documents would have been in your packet provided at settlement. They can also be found here on the Kings Creek Land POA website under the Association Documents tab. That area is password protected, but if you are unable to access it, we can arrange to get you a copy of the documents.

Generally, house designs are to resemble those of a tidal rural community reminiscent of architecture from 1900 to 1920. This would exclude ranch-style houses or other styles which exhibit a long, low close to the ground profile. Porches are to be a significant architectural feature; and we like, and generally require, porch railings. Minimum home size is 1400 square feet and two story maximum height. Homes can include the equivalent of a three-car garage, either attached or detached. We prefer attached buildings to increase open space, and we prefer garages not to face the street unless the lot width does not permit. High quality vinyl siding is permitted for exterior finishing, but Hardy board is the written preference.

These are some basic rules and preferences as it's difficult to cover evey situation. Northampton County also has many building requirements for setbacks, well locations and septic design, etc. Your building plans must be approved by the Kings Creek Landing Architectural Review Committee prior to construction.  We much prefer to help you get started than to turn down a plan on which you have invested a lot of time and money.

After the 2020 road repair project, on August 8, 2020, the Board of Directors voted to implement a $1,000 deposit to be held in escrow by the KCL Property Owners Association for potential damage to community property including the community-maintained roads during any new-home construction process. Escrow funds will be returned to the property owners after the issuance of a certificate of occupancy and no damage is noted. Any necessary repairs from damage to community property or roads amounting over the $1,000 deposit will be the responsibility of the property owners.

FAQs for Potential Homeowners

 

How much are the POA dues? Currently, annual dues are $840.00.

 

Are POA dues assessed to unimproved lots? Full POA dues are assessed on unimproved lots, and there is an additional annual mowing fee of $250 if the lot owner chooses to have the community's mowing contractor mow the unimproved lot during the growing season (normally May through September). Unimproved lot owners have access to all amenities.

 

Is there a time limit to building a house once a lot is purchased? There is no time limit to build after a lot is purchased.

 

Is there an age restriction in the POA? There are no age restrictions.

 

Are there any restrictions about renting out the house?  Rentals are allowed, but there are guidelines requiring a copy of the lease and names and vehicle tag numbers of tenants.  Tenants are required to sign agreeing to the rules, a copy of which must be provided to them. Please see Covenants for more information. A $50.00 Administrative Fee will be charged per lease.

 

Are there size restrictions on how small/big a house can be? Per the Covenants and Restrictions, only single-family homes are allowed and must have at least 1,400 square feet of heated living space. There is an Architectural Review Committee which must approve each project and requires an application process. 

 

Can we build a detached garage with an apartment above the garage in the rear of our lot? Only single-family homes are allowed, so no garage apartments are permitted. Garages can be attached or detached, but not both.

 

Does Kings Creek have town water and sewage? Homeowners have their own wells and septic tanks.

 

Do lots with a boat slip right have any additional POA dues? Some of lots are assigned boat slips, and there are no additional POA fees for those lots at this time.
